Domestic & International Legal Rest Waiver Adds Flexibility

The domestic legal rest provisions of our JCBA requires the protection of a planned legal rest at home consists of twelve (12) hours free from duty.  At the same time, in order to offer Flight Attendants maximum schedule flexibility, Flight Attendants may waive the minimum home legal rest to trip trade/pick up pairings subject only to the following:

 

  • The minimum home legal rest between the pairings shall be reduced to ten (10) hours minimum rest for all purposes;

  • In the event the Flight Attendant trades or drops one of the pairings resulting from the waiver and the minimum home legal rest between her/his pairings is reestablished, the ten (10) hour minimum rest shall no longer apply.

 

In addition, our minimum legal rest following the completion of an International pairing may also be waited to facilitate trip trading/pick up as provided in Section 6.W.2. of our Contract.  However, the minimum rest waiver is tied to the flight/deadhead time in the last duty period as provided in Section 6.W.2.

Flight Attendants may waive their legal rest at home in order to trip trade/pick up subject only to the following:

  • The minimum home legal rest between the pairings shall be reduced to the applicable trip trade/pick up waiver minimum rest for all purposes;
  • In the event the Flight Attendant trades or drops one of the pairings resulting from the waiver and the minimum home legal rest between her/his pairings is reestablished, the trip trade/pick up waiver minimum rest shall no longer apply.
